By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks transfer of investigation in case bearing CT Cases No. 2002/2023 at P.S.: Kalkaji, Delhi to the District Investigative Unit (‘DIU’)/Crime Branch or Central Bureau of Investigating.

The essence of the submissions made by the learned counsel appearing for the petitioner is that, despite a clear direction contained in order dated 25.03.2025 passed by the learned JMFC-06, South East-District, Saket Courts, New Delhi, and despite lapse of almost one year, no steps have been taken to proceed with the investigation. 3. Learned counsel has drawn attention of this court to Status Reports dated 30.05.2025, 11.08.2025 and 24.12.2025 filed by the Investigating Officer (‘I.O’). before the learned trial court, to submit

that, apart from exchanging the letters with the concerned Banks, the I.O. has taken no steps in the investigation.

Learned counsel for the petitioner submits, that considering the nature of the petitioner’s grievance, steps that are required to be taken towards investigation are as set-out in para 6 of Application dated 19.03.2025 filed by the petitioner before the learned Magistrate, a copy of which is appended as Annexure-P5 to the present petition.

Learned counsel submits, that the petitioner had even sought change of the I.O. vidé Complaint dated 07.11.2025 addressed to the concerned DCP for the area, but to no avail.

Issue notice.

Mr. Rahul Tyagi, learned ASC appears on behalf of the State on advance copy; accepts notice; and while disputing the contentions raised by the petitioner, on instructions, does not oppose the transfer of the investigation to the concerned DIU.

In view of the prayers made, it is not considered necessary to delve any further into the matter.

Accordingly, the petition is allowed, thereby directing that investigation in CT Cases No. 2002/2023 at P.S.: Kalkaji, Delhi be transferred to DIU, South-East District, New Delhi within 01 week.

The petition is disposed-of in the above terms.

Pending applications, if any, also stand disposed-of.
