Applicant seeks regular bail in a case arising out of FIR No.0092/2025 dated 10.08.2025, under Sections 20/21/22/25/29 of Narcotic Drugs and Psychotropic Substance Act, 1985 (NDPS Act), registered at P.S. Chankya Puri, Delhi.

On 10.08.2025, an unfortunate accident took place in which two persons lost their lives. They were, allegedly, hit by one Mahindra Thar and the applicant herein was driving the abovesaid car.

Besides being booked for offences under Sections 281/105 of Bharatiya Nyaya Sanhita, 2023 (BNS) for the abovesaid accident, when the police team reached the spot, on the basis of suspicion, one laptop bag lying in the abovesaid car was recovered which revealed recovery of Ganja weighing 21.26 gram, Tobacco weighing 15.49 gram, Cocaine weighing 0.30 gram, Charas weighing 4.17 gram, MD weighing 23.47 gram and LSD weighing 2.6

During interrogation, the applicant revealed names of those persons from whom he had procured the abovesaid contraband and his police custody remand was taken and as per the prosecution story, one such person has already been arrested.

Learned counsel for the applicant submits that there is not enough of clarity whether the contraband alleged to be LSD , is in fact, LSD and such fact was even appreciated by the learned Trial Court in its order dated 26.12.2025, while observing that there was no explanation coming from the investigating agency as to why the test on the suspicious substance i.e. LSD, was not conducted immediately and it thus, went on to hold that there was no prima-facie material at that stage to conclude that such substance was LSD .

Admittedly, the other substances i.e. Ganja , Cocaine and Charas , fall within the ambit of ‘small quantity’ whereas MD is found to be of ‘intermediate quantity’.

As per learned counsel for applicant, the applicant is in his twenties and in prime of his youth, with no previous involvement of any nature whatsoever.

Learned APP for the State, duly assisted by IO, while opposing the bail plea of the applicant herein submits that there is conscious recovery of multiple contraband and since FSL report is still awaited, therefore, at this stage, it cannot be presumed that the recovered substance was, not LSD .

He, however, does admit that the quantity of other contraband falls within the ambit of ‘small’ or ‘intermediate quantity’.

Nominal roll of the applicant has been requisitioned, which reveals no other previous antecedents of the applicant herein. Same is taken on record.

The status report, which the investigating agency had filed before the learned Court of Sessions, has also been perused.

Charge-sheet has already been filed and the case is now listed for consideration on charges on 08.04.2026.

Keeping in mind the overall facts of the case and the young age of the applicant coupled with the fact that he has no previous antecedents, the applicant is directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to satisfaction of learned Trial Court/CJM/Duty Magistrate.
