By virtue of the present petitioner under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioner seeks direction to the Competent Authority to consider the name of the petitioner for pre-mature release in Case/FIR No.359/2009 registered at PS.: Vasant Vihar under Section 302 of Indian Penal Code, 1860 ( IPC ) in the upcoming Sentence Review Board Meeting.

Learned ASC for the State appearing on advance service, without adverting to the merits involved in the present case, submits that if found eligible the name of the petitioner shall be duly considered in the upcoming Sentence Review Board Meeting ( SRBM ) in accordance with law,
