By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioner seeks quashing of FIR No.007/2023 dated 03.01.2023 registered at PS.: Shalimar Bagh, Delhi under Sections 406/498A/34 of the Indian Penal Code, 1860 ( IPC ) and all proceedings emanating therefrom, in view of the Settlement Agreement dated 30.06.2025.

The present petition is accompanied by the aforesaid Settlement Agreement dated 30.06.2025 [ Annexure P6(Colly) ], and is also supported

by affidavits of the petitioner and of respondent no.2, alongwith proofs of their respective I.Ds.

Issue notice. Learned ASC for the State accepts notice and confirms that he has no objection to the quashing of the FIR No.007/2023 dated 03.01.2023.

Respondent no.2, present in Court, also accepts notice and confirms that the petitioner and respondent no.2 have already been granted divorce by mutual consent vide Decree of Divorce dated 24.09.2025. Further, she affirms that prior thereto she has also entered into the Settlement Agreement dated 30.06.2025 [ Annexure P6(Colly) ] with the petitioner in compliance whereof, the petitioners have already paid her a total sum of Rs.10,00,000/-, and also handed over a further sum of Rs.5,10,000/- in Court today as a full and final settlement qua all her claims including alimony, maintenance (present, past and future), stridhan etc., vide Cheque/ Demand Draft No.902648 dated 30.01.2026 (State Bank of India, Branch: Shalimar Bagh, Delhi). Lastly, respondent no.2 states that she has no objection to the quashing of the FIR No.007/2023 dated 03.01.2023.

Further, the petitioner and the respondent no.2, present in Court, as well as their credentials, on record, have been identified by the Investigating Officer.

In view of the fact that a settlement has already been arrived at between the parties, they shall remain bound by all the terms and conditions contained therein and for the well-being of the minor child born out of the wedlock between the petitioner and respondent no.2, following the law laid down by the Supreme Court in Jitendra Raghuvanshi & Ors. Vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs.

State of Punjab & Anr. (2012) 10 SCC 303 , this Court is of the opinion that continuation of the aforesaid FIR No.007/2023 dated 03.01.2023 will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.007/2023 dated 03.01.2023 registered at PS.: Shalimar Bagh, Delhi under Sections 406/498A/34 of IPC and all proceedings emanating therefrom are quashed. 9. Accordingly, the present petition is disposed of.
