The matter was listed for 11.09.2026 and is taken up today as 11.09.2026 was declared as a holiday on account of BRICS Summit, 2026.

The instant petition is for the following reliefs:-

“i) Quash the FIR bearing No. 608/ 2023 dated 19.11.2023, Malviya Nagar Police Station, South District, New Delhi registered under Section 323 & 341 of the Indian Penal Code, 1860, Charge-sheet dated 04.01.2024 and all consequential proceedings arising therefrom;

ii) Stay all the proceedings in connection with the Impugned FIR and the Impugned Charge-sheet during pendency of the present Petition.”

Learned counsel appearing on behalf of the petitioner submits that the FIR No.608/2023 dated 19.11.2023 was registered as a counter blast after registration of FIR No.551/2023 dated 16.10.2023 against respondent no.2 at

the instance of the petitioner. It is, thus, contended that the charge sheet and the FIR deserve to be quashed.

Ms. Rupali Bandhopadhya, ASC for State, however, points out that after investigation and filing of the charge sheet, the concerned Court has already framed charges against the petitioner and the order of framing of charges had not been challenged by the petitioner.

Learned counsel for the petitioner points out that both the FIRs are essentially related to the incident dated 26.09.2023. It is thus contended that trial in relation to both the FIRs be conducted together.

The Court finds that the said request can be made before the Court of competent jurisdiction, who shall adjudicate the same in accordance with law.

With respect to other aspects on merits, liberty is granted to the petitioner to raise all the issues during the pendency of the trial.

The concerned Court shall look into all the aspects in accordance with law.

¶25

With regard to the grievance raised by the petitioner concerning the lack of progress in FIR No. 551/2023, the petitioner shall be at liberty to place the said grievance before the concerned Court, which is seized of the matter.

The undertaking tendered on behalf of the concerned Investigating Officer, through Ms. Rupali Bandhopadhya, is taken on record, to the effect that no adjournment shall be sought on his behalf and that he shall extend full cooperation in the proceedings and in the investigation.

Needless to state, in the event of any breach of the aforesaid undertaking, the concerned Court shall be at liberty to pass such appropriate
