The instant petition has been filed for the following reliefs:

“I. Pass an order to quash the FIR No. 302 of 2021 dated 16.06.2021 under Section 457 / 380 IPC registered at PS Sangam Vihar to the qua the petitioners and their Father and to quash Final Report if any and subsequent proceedings emanating therefrom.

II. Pass an order granting protection to the petitioners from any police action against the petitioners at the behest or instance of the father or relatives of the petitioner No. 2 herein.

III. Pass an order directing the commissioner of Police to hear and dispose of the representation dated 02.04.2024. Including the contents of the present petition and pass appropriate directions with regard to the protection of the petitioners.

IV. Pass an order directing the police to make enquiry if any from the petitioners within the premises of this Hon'ble court so as to ensure the safety, security and dignity of the petitioners herein.

V. Pass an order for quashing and setting aside the Notices At annexure P-

VI. Pass any such direction or order that this Hon'ble court deems fit and proper in the facts and circumstances of the above-mentioned case.”

The facts of the case would indicate that there was an interfaith marriage between petitioner no.1 and petitioner no.2. Petitioner No. 3 seems to be the father of petitioner no.1. Respondent No. 4 is the father of petitioner no.2. At the instance of respondent no.4, the instant FIR came to be registered initially against the unknown person. It appears that during investigation, the complainant disclosed the name of the present petitioners. Thereupon, the petitoners have filed the instant petition.

It has also been pointed out that an FIR 467/2021 for offence under Section 363 of the Indian Penal Code, 1860 was also registered against petitioner no.1. In the said FIR, no cognizable offence was made out, accordingly, a cancellation report was filed.

In the instant FIR as well, as of now, nothing incriminating has been found against the petitioners, as has been submitted by the concerned Investigating Officer.

The Court directs the concerned Investigating Officer to take the investigation to its logical conclusion and if there is no evidence against the petitioners, let the cancellation report be presented without any further delay.

All steps be taken within eight weeks from the date of receipt of a copy of the order passed today.
