The present petition has been filed under Article 226 of Constitution of India read with Section 528 of BNSS with the prayer that respondents may be directed to consider and grant first spell of furlough to the petitioner for three weeks.

Learned counsel for the petitioner submits that though the furlough was being sought for the reason that his father was unwell, unfortunately, in the interregnum, his father has already expired yesterday i.e. on 14.09.2026.

She also submits that when an application was filed before the Prison Authorities seeking custody parole , such request has been acceded to as he has been granted custody parole for a period of six hours, in order to enable him to do the last rites of his father at his native village in Bihar.

Mr. Anand V. Khatri, learned GNCTD represents respondent No.1 and, in all fairness, submits that factum of death of father of petitioner has already been duly verified and pursuant thereto only, the Prison Authorities have decided to grant custody parole .

Learned counsel for the petitioner draws attention of the Court to order dated 13.07.2026 passed by this Court in W.P.(CRL) 2795/2025 whereby, this Court gave him liberty to file fresh application seeking furlough or parole, as the case may be, with the direction to Competent Authority to consider such application in accordance with law. 7. Learned counsel for the petitioner submits that after the abovesaid liberty was granted to the petitioner by this Court on 13.07.2026, the petitioner has already filed an application for grant of first spell of furlough and the police verification report in relation thereto has already been sent to the Director General, BSF by Jail Authorities on 14.08.2026. She submits that abovesaid furlough request is still pending adjudication and has yet not been answered. She, however, submits that in view of the abovesaid unfortunate development in the interregnum and in the peculiar facts and circumstances, request for grant of furlough be acceded to.

The Nominal Roll of the petitioner is already on record which clearly indicates that he has not been granted furlough in the years 2025 and 2026. 9. Learned counsel for the petitioner submits that there is nothing to indicate that petitioner is ineligible for grant of furlough. 10. Learned CGSC for respondent No.2, however, submits that for want of requisite instructions, he would not be in a position to make any statement about his eligibility and also about the fate, if any of his application seeking furlough. Fact, however, remains that the custody parole has already been

granted to the petitioner for a period of six hours and the factum of death of the father of the petitioner has been duly verified. Keeping in mind his jail conduct for the last one year, which is recorded as satisfactory, and abovesaid peculiar facts, the present petition is allowed and petitioner is granted furlough for a period of three weeks from the date of his release on his furnishing personal bond in a sum of Rs.25,000/- with one surety of like amount, subject to satisfaction of learned Jail Superintendent with the following conditions:-

(i) The petitioner shall report to the SHO of the local area, once a week on every Sunday at 10:00 AM.

(ii) The petitioner shall furnish a telephone number to the Jail Superintendent on which he can he contacted, if required. After his release, he shall also inform his telephone number to the SHO of the police station concerned.

(iii) Immediately upon the expiry of period of furlough, the petitioner shall surrender before the Jail Superintendent.

(iv) The period of furlough shall be counted from the day when the petitioner is released from jail.

A copy of this order be given dasti to learned counsel for the petitioner under the signatures of Court Master.

A copy of this order be also sent to Jail Superintendent for information.
