The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking quashing of FIR No. 0262/2026 , registered at Police Station Narela, District North, Delhi, for offences punishable under Sections 110/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’), along with all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

Petitioner No. 1 and Respondent No. 2 are present before this Court and have been duly identified by their learned counsel and the Investigating Officer.

The brief facts of the case are that the aforesaid FIR came to be registered on the complaint of Respondent No. 2 against the petitioners. During the pendency of the proceedings, the parties amicably resolved their disputes. Initially, a settlement dated 08.05.2026 was arrived at between the parents of the petitioners and Respondent No. 2. Thereafter, an additional Settlement/Memorandum of Understanding dated 22.08.2026 was executed between the petitioners and Respondent No. 2. Respondent No. 2 has also executed an affidavit-cum-No Objection Certificate in support of the present petition.

On a query made by this Court, Respondent No. 2, who has been identified by the Investigating Officer, categorically states that she has entered into the aforesaid settlements out of her own free will and without any force, pressure, coercion or undue influence. She further states that all disputes and differences between the parties have been amicably resolved and that she has no objection if the present FIR and the consequential proceedings arising therefrom are quashed.

In view of the aforesaid settlement between the parties, which has been entered into voluntarily and without any coercion, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in further acrimony between the parties. It would, therefore, be in the interest of justice to quash the FIR and the proceedings pursuant thereto. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.
