Nagarik Suraksha Sanhita, 2023 (‘BNSS’), seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondent nos.1, 2 and 3 to produce Master ‘X’, the son of the petitioner and the respondent no.4.

In the petition, it is alleged that there are matrimonial disputes going on between the petitioner and the respondent no. 4, and the petitioner has also filed a petition seeking divorce from respondent no. 4, which is presently pending adjudication before the concerned Family Court. It is further alleged that, in the evening of 30.03.2026, respondent no. 4 had forcefully taken away the child from the custody of the mother of the petitioner. 3. Pursuant to our directions issued on 08.04.2026, respondent no. 4, along with the child, is present in person before us. We have interacted with the petitioner and respondent no. 4. 4. As an interim measure, they both agree that the shared custody of the minor child shall be handed over by respondent no. 4 to the petitioner on 14.04.2026 at 05:00 PM at the petitioner's residence. 5. They further agree that the child, for the time being, will continue to go to the same school where he was studying in Gurugram, and on every Friday, respondent no. 4 shall pick up the child from the school and return him to the petitioner, at 02:00 PM on Sunday, by dropping him at the petitioner’s residence. 6. The parties, that is, the petitioner and respondent no. 4, will also explore the possibility of arriving at a settlement of all their disputes before the Delhi High Court Mediation and Conciliation Centre (‘Mediation Centre’). They shall appear before the Mediation Centre
