1. The present petitions have been filed alleging wilful disobedience and non-compliance of the undertaking dated 31^st January, 2023, given before the Court of Metropolitan Magistrate, NI-02, Tis Hazari Courts, West District, Delhi, in CC 366/2019.

The present contempt petitions have been filed since it is the case of

the petitioners that the respondents are not adhering to the payment schedule in terms of the Settlement Agreement dated 31^st January, 2023.

A Compliance Affidavit dated 07^th April, 2026, had been filed on behalf of the respondents, as per which, a revised and agreed payment schedule of remaining instalments has been given. The said table is reproduced as under:

This Court records the statement made by learned counsel appearing for the respondents that in terms of the said revised schedule for payment,

the instalment which was due and payable by 30^th June, 2026, has been duly released to the petitioners.

Learned counsel appearing for the respondents undertakes that the next instalment shall be released to the petitioners on 30^th September, 2026, as per the revised payment schedule, and that the revised payment schedule, as aforesaid, shall be duly followed by the respondents.

However, at this stage, learned counsel appearing for the petitioners submits that the revised payment schedule has not been confirmed by the petitioners.

¶47

Be that at it may, since the respondents have undertaken to make full payment, in terms of the Settlement Agreement dated 31^st January, 2023 to the petitioners as per the said schedule, the undertaking of the respondents is taken note of and the respondents are held bound by the same.

In case, the respondents breach the aforesaid timelines, the petitioners shall be at liberty to revive the present petitions.

Noting the aforesaid, the present petitions are accordingly disposed of.
