The present Petition has been filed under Sections 11 and 12 of the Contempt of Court Act, 1971, for initiation of contempt proceedings as against the Respondents for the alleged violation of the Order dated 22.11.2018 in CS (OS) 98/2018 titled as “Rubal Jeet Singh Sayal vs. Pradeep Kumar Bhola & Ors.” .

Learned counsel appearing on behalf of the Petitioner candidly submits that he has also preferred an Execution Petition vide diary no. E- 284981/2026.

Learned counsel appearing on behalf of the Respondents also submits that they have also filed an Execution Petition being EX. P. 67/2019.

Order dated 06.02.2019, has observed that both the parties have not implemented the settlement as recorded and blame each other for the non-implementation of the same and also observed that they may take steps for execution of the order. The said order reads as follows:

“The parties have not implemented the settlement recorded by this Court on 22^nd November, 2018 and blame each other for the same. Since the suit has already been disposed of, the parties are at liberty to execute the order dated 22^nd November, 2018 in accordance with law.”

In view thereof, this Court is of the view that no wilful disobedience can be attributed to the Petitioner herein, particularly when this Court has already recorded that both parties are responsible for the non-success of the settlement arrived at between them. This Court also takes into consideration the fact that both parties have initiated execution proceedings in respect of the same order, the alleged violation of which forms the subject matter of the present Contempt Petition. The Petitioner has clearly initiated multiple proceedings to achieve pretty much the same purpose.

In view of the aforesaid, no occasion arises for this Court to keep this matter pending.

Accordingly, the present Petition, along with all pending application(s), stands dismissed.
