The present Petition has been filed under Sections 10 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India, 1950, for initiating contempt proceedings against the Contemnor/Respondent for willfully violating the terms and conditions of Memorandum of Agreement dated 18.12.2017 entered into between the parties and willfully resiling from undertaking given by the Contemnor before the learned Judge, Family Courts, Saket as recorded vide Order dated 23.07.2018 passed in HMA 1204/2018, titled “Ms. Nandni Ghai v. Mr. Deepak Ghai” .

Learned counsel appearing on behalf of the Respondent, on instructions, submits that in RC proceedings being RC-DRT 526 of 2019 which have been initiated in respect of loan taken from Catholic Syrian Bank, he will file an Undertaking to the effect that he
