The present petition has been filed alleging wilful disobedience of the order dated 15^th December, 2025 passed by a Division Bench of this Court in W.P.(C) 18964/2025, wherein, by relying upon the judgment in the case of Bharti Bahuguna Versus Kendriya Vidyalaya Sangathan and Others, SCC OnLine Del 5781 , the writ petition was disposed of in terms of the judgment.

It is to be noted that as per the aforesaid judgment, the petitioner has been held entitled to receive a pension as per the General Provident Fund (“GPF”)-cum-Pension Scheme in accordance with the Kendriya Vidyalaya

Sangathan (“KVS”) Office Memorandum (“OM”) dated 01^st September, 1988, with interest @ 6% per annum on the due amount from the date the same had fallen due till the payment of pension.

Issue notice. Notice is accepted by learned counsel appearing for the respondents.

Learned counsel appearing for the respondents submits that the judgment in the case of Bharti Bahuguna (supra), on the basis of which the aforesaid order dated 15^th December, 2025, has been passed, already stands stayed by the Supreme Court.

5. He hands over to this Court an order dated 09^th July, 2026, passed by this Court in another matter being CONT.CAS(C) 1144/2026, which dealt with the submissions with regard to the aforesaid case of Bharti Bahuguna (supra).

Perusal of the aforesaid order clearly shows that the judgment in the case of Bharti Bahuguna (supra) already stands stayed by the Supreme Court in Special Leave Petition (“ SLP”)(C) 15365/2026 vide order dated 06^th April, 2026.

He submits that there is a batch of matters pending before the Supreme Court and the case number for challenge to the judgment of Bharti Bahuguna (supra) before the Supreme Court, is bearing SLP Diary No. 5044/2026.

At this stage, learned counsel appearing for the petitioners submits that the order dated 15^th December, 2025, which is the subject matter of the present petition has still not been challenged by the respondents.

However, learned counsel appearing for the respondents submits that the aforesaid order dated 15^th December, 2025, is based upon the judgment, which already stands stayed by the Supreme Court.

Considering the submission made before this Court, no orders can be passed by this Court at this stage.

Noting the aforesaid, the present petition, along with the pending application, stands disposed of.
