By way of the present writ petition, the petitioner is seeking following

prayers:

“A. Issue an appropriate writ, order or direction, including a writ in the nature of Certiorari, quashing and setting aside the Impugned Order bearing No. DSOWF/101/11/RULES dated 12.06.2026 issued by the Hony. Secretary, Defence Services Officers Welfare Fund.

B. Issue an appropriate writ, order or direction, including a writ in the nature of Mandamus, directing the Respondents to forthwith restore the Petitioner's permanent membership of the Defence Service Officers Institute along with all consequential rights, privileges, facilities and benefits available to him as a permanent member, including unrestricted access to the Defence Service Officers Institute premises and all facilities attached to such membership.”

The learned counsel appearing for the respondents states that the present writ petition is not maintainable and in this regard, he draws this Court’s attention to the judgment dated 28.09.2011, titled as Harish Bhatt & Ors. vs. Union of India & Ors , passed by the Co-ordinate Bench of this

However, at this stage, this Court notes that the primary concern of the present petitioner herein is that his membership was unlawfully terminated, without issuing a show-cause notice, and that despite several letters written to DSOI, no response has been received.

In these circumstances, at this stage, not getting into the issue as to whether the present writ petition is maintainable or not, this Court deems it apposite to direct that the present writ petition be treated as representation on behalf of the petitioner herein, and the respondents are directed to decide the same within a period of two months from date, in accordance with DSOI rules, if applicable, under intimation to the petitioner.

It is clarified that the matter has not been not heard on merits.

In the above terms, the present writ petition stands disposed of.

¶23

In case of any further grievance, the petitioner is at liberty to avail of his remedies as per law.
