The present writ petition has been filed seeking directions to the respondent nos. 1 to 6 to take action against the unauthorized construction raised by the private respondent nos. 7 and 8, in the subject properties bearing nos.:-

i. C-34-D, Pocket C, Gangotri Enclave, Alaknanda, New Delhi110019;

ii. B-5I-C, Pocket B, Gangotri Enclave, Alaknanda, New Delhi-110019; iii. B-52-B, Pocket B, Gangotri Enclave, Alaknanda, New Delhi-110019.

Status report was filed on behalf of respondent-MCD on 25^th September, 2025. As per the said status report, the following properties were old constructions and therefore, entitled to protection under National Capital Territory of Delhi Laws (Special Provisions) Second Act, 2011:-

i. C-34 D, Pocket-C, Gangotri Enclave, Alaknanda, New Delhi.

ii. B-51 C, Pocket-B, Gangotri Enclave, Alaknanda, New Delhi.

iii. B-52 B, Pocket-B, Gangotri Enclave, Alaknanda, New Delhi.

Accordingly, vide orders dated 25^th September, 2025, the respondentMCD has held that subject properties are entitled to the protection under the aforesaid Act till 31^st December, 2026.

During the course of proceedings in the present writ petition, the property of the petitioner was also inspected and a demolition order was passed against the same.

Subsequently, the petitioner has filed an appeal before the Appellate Tribunal, MCD (‘ATMCD’), wherein interim protection has been granted in favour of the petitioner.

Taking into account the aforesaid submissions, the present writ petition is disposed of with the direction that the respondent-MCD shall take appropriate action based on the outcome of the appeal before the ATMCD in accordance with law.

In the event, the petitioner has any grievance with regard to protection granted by the respondent-MCD to the subject properties under National Capital Territory of Delhi Laws (Special Provisions) Second Act, 2011, it would be open for the petitioner to invoke appropriate remedies in accordance with law.
