The present writ petition has been filed seeking directions to respondent-MCD to take action against the unauthorized construction being carried out by respondent no. 3 in Flat No. 151, Sahyog Apartments, Mayur Vihar, Phase-1, Delhi-110091 (‘subject property’).

In the order passed by this Court on 12^th February, 2026, it was noted that MCD has booked the property of respondent no.3 for unauthorized construction and a Show Cause Notice has been issued on 2^nd February, 2026. Further, a Work Stop Notice has also been issued on 4^th February, 2026.

In view of the aforesaid, the respondent-MCD was directed to take action in accordance with law and all rights, contentions and legal remedies of respondent no.3 were kept open.

Subsequently, a speaking order was passed by the respondent-MCD on 26^th February, 2026 qua the subject property, wherein it was held that there was excess coverage/deviation against the standard plan of the Delhi Development Authority (DDA) by respondent no.3 by raising of brick walls and removal of load bearing walls. Accordingly, the respondent no.3 was directed to demolish the unauthorized construction.

Counsel appearing on behalf of respondent no.3 submits that against the aforesaid speaking order, an appeal has been filed by respondent no.3 before the Appellate Tribunal, MCD (ATMCD) being Appeal No.219/2026 titled Jag Mohan Gupta v. MCD , in which an interim protection has been granted in favour of respondent no.3.

In view thereof, the present writ petition is disposed of while directing respondent-MCD to take appropriate action based on the outcome of the appeal filed by respondent no.3.
