This application has been filed by the petitioner seeking early hearing of the writ petition.

The present writ petition has been filed against the impugned demolition order dated 26^th May, 2026 issued by the respondent/MCD against the property bearing no. 5218 & 5218-A, Gali No. 5- 6, Krishna Nagar, Karol Bagh, New Delhi (hereinafter ‘subject property’).

in the month of June, 2026, the petitioner was constrained to file the present writ petition before this Court. Notice in CM APPL. 39172/2026 filed along with the present petition was issued by the vacation bench on 22^nd June, 2026.

Mr. Ankit Jain, senior counsel appearing on behalf of the petitioner submits that an appeal along with the application for interim stay has been filed by the petitioner, which was listed before the ATMCD on 3^rd July, 2026 and has now been adjourned to 18^th August, 2026.

In view of the appeal having been filed by the petitioner before the ATMCD, the present writ petition has become infructuous and is accordingly disposed of as such.

Needless to state, the ATMCD shall consider the application for interim stay filed by the petitioner on 18^th August, 2026. Till the application for interim stay filed by the petitioner is considered by the ATMCD on 18^th August, 2026, no coercive steps shall be taken by MCD qua the subject property.

Pending application stands disposed of.
