The present petition is filed under Section 29A of the Arbitration and Conciliation Act, 1996 (‘Act of 1996’), seeking an extension of the mandate of the three (3) member Arbitral Tribunal.

Learned counsel for the Petitioner states that the last sitting of the Arbitral Tribunal was held on 24.02.2025.

4.1. He states that an e-mail was received on 03.04.2025 from the Arbitral Tribunal addressed to the Petitioner/Claimant seeking the consent of the parties for extension of Tribunal’s mandate (which was expiring on

4.2. He states that the Petitioner/Claimant vide email dated 15.04.2025 gave its consent for extension of the mandate of the Arbitral Tribunal by six (6) months.

4.3. He states that similarly, the Respondents as well gave their consent vide e-mail dated 16.04.2025 for extension of the mandate of the Arbitral Tribunal for the period of six (6) months. He states that, however, the Respondents have recorded in the said e-mail that as per the Respondents the mandate of the Arbitral Tribunal had expired on 09.01.2025 and not on 16.04.2025.

4.4. He states that as per the Petitioner/Claimant, the mandate of the Arbitral Tribunal was set to expire on 16.04.2025 and with extension of six (6) months as per the consent of parties, would have expired on 16.10.2025. He states that, however, the Arbitral Tribunal vide e-mail dated 28.04.2025 has directed the parties to approach the Court for extension of the mandate and the petition has been filed in this background.

Learned counsel for the Respondents accepts notice.

Learned Senior Counsel appearing on behalf of the Respondents states that the Respondents dispute the allegations made in this petition against the Respondents with respect to the conduct of the arbitral proceedings. He states that however, the Respondents have no objection to the extension of the mandate of the Arbitral Tribunal as sought in the present petition.

This Court has heard the learned counsel for the parties and perused the records.

This Court has been apprised that the Arbitral Tribunal is still hearing arguments on the application filed by the Petitioner/Claimant under Section 17 of the Act of 1996.

Keeping in view the intervening June, 2025 vacation, the mandate of the Arbitral Tribunal is extended until 31.05.2026.

It is made clear that this Court has not expressed any opinion on the allegations made in the petition by the Petitioner against the Respondents vis-à-vis the conduct of the arbitral proceedings.

Accordingly, the present petition is disposed of. 13. The digitally signed copy of this order, duly uploaded on the official website of the Delhi High Court, www.delhihighcourt.nic.in, shall be treated as a certified copy of the order for the purpose of ensuring compliance.
