The instant petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita (hereinafter “BNSS”) (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioner seeking the following reliefs:

“i. issue a writ in the nature of Habeas Corpus or any other writ, order or direction as may be deemed appropriate by this Hon’ble Court, directing the respondents herein to produce/trace the missing wife namely Sunaina Vohra and minor daughter namely ‘N’ of the Petitioner herein, before this Hon’ble Court; and/or;

ii. considering the seriousness of the matter, the matter be

transferred to the Anti-Human Trafficking Unit (Crime Branch), Delhi Police. Who shall conduct immediate and diligent investigation under the supervision of a Senior Officer not below the rank of an ACP and file a Status Report accordingly as per instruction of this Hon’ble Court; and/or iii. Any other and further order (s) and direction(s) as this Hon’ble Court may deem first and proper under the facts and circumstances of the case be passed in favour of the petitioners and against the respondents.”

The facts of the case are that the petitioner has filed the present petition seeking the production of his wife, aged 35 years, and his minor daughter, aged four years. According to the petitioner, his wife and daughter have been missing since 12^th October, 2024, at around 6:00 p.m. Despite making inquiries with various relatives, he was unable to trace them, leading to the registration of General Diary No. 0182A.

The status report filed by the State is on record wherein it is stated that petitioner’s wife and daughter have been missing since 12^th October, 2024. It is further stated that the petitioner’s wife left a handwritten note in which she wrote “Main Paresan ho chuki hu isiliye ghar chodhkar jaa rahi hu mujhe dhundhne ki kosis mat karna nahi toh mai marjaungi aur mere mummy papa ko btadena” .

Learned standing counsel for the State submitted that the petitioner’s four-year-old daughter has already been recovered. It is further stated in the status report that during the investigation, the Investigating Officer undertook multiple efforts for the recovery of both the petitioner’s missing daughter and wife. These efforts included circulating information regarding the missing persons to the Missing Person Squad, NCRB, SCRB, SSPs, and DCPs across India, as well as all SHOs in Delhi through WT messages.

Additionally, their photographs were uploaded on Zipnet, a reward declaration was issued, and a request for publication in newspapers was sent. Furthermore, the photographs of the missing persons were displayed in public areas such as metro stations, local markets, and weekly markets.

Learned standing counsel for the State further submitted that since the petitioner’s daughter has been recovered and, as per the status report, his wife left home of her own will, as indicated in her handwritten note. Therefore, nothing is now remaining for further adjudication. 6. At this juncture, learned counsel for the petitioner, on instructions, submitted that he does not wish to pursue the present petition any further. 7. Heard learned counsel for the parties and perused the contents of the status report as well as the instant writ petition. 8. As per the status report, the petitioner’s wife has categorically stated that she left her home of her own free will, as evidenced by the handwritten note she left behind. The investigation does not indicate any coercion or force in her departure. Therefore, in light of the submissions made by the learned counsel for the parties and the contents of the status report, no further directions are warranted in the present matter.

Accordingly, the instant petition, along with all pending applications, is disposed of, as nothing remains for further adjudication.
