Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the Petitioners seeking quashing of FIR No.0428/2022 registered under Sections 498A/406/34 IPC at P.S. Rajouri Garden in terms of the Settlement dated 15.03.2024.

Marriage of the Petitioner No.1 with Respondent No.2-wife was solemnized on 18.06.2021 as per Hindu Rites and Customs and a child was born on 15.10.2017. However, due to temperamental differences, Petitioner No.1 and the Respondent No. 2 started residing separately since 11.06.2022 and the Respondent No. 2 registered FIR No. 0428/2022 under Sections 498A/406/34 IPC at P.S. Rajouri Garden.

It is submitted that with the intervention of family members, relatives and well wishers, Petitioner No.1 and Respondent No.2 have resolved their disputes and arrived at an amicable settlement, terms whereof have been recorded in Settlement dated 15.03.2024.

The Petitioner No. 1 and the Respondent No. 2 are present in person and are indentified by the Investigating Officer. The parties had appeared before the Court of learned Joint Registrar and their statement was recorded. It is stated by the parties that they have arrived at a settlement without any force, coercion and undue influence and pressure and they have voluntarily signed the Settlement dated 15.03.2024. The parties have endorsed the amicable Settlement and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement.

It is stated that the parties have been happily living together for last 15 months and now they have a child as well. 6. Respondent No.2 submits that she has no grievance against the Petitioners and also ‘no objection’ to the quashing of FIR. She affirms that she is happily living together with the Petitioner No.1. 7. In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner No.1 and Respondent No.2, which has been amicably resolved in term of Settlement dated 15.03.2024 and the fact that parties have been living together for last 15 months and have a child as well. Also the Respondent No.2 has given ‘no objection’ to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

Consequently, FIR No. 0428/2022, under Sections 498A/406/34 IPC, registered at P.S. Rajouri Garden and proceedings emanating therefrom are
