1. Petition under Section 528 BNSS has been filed on behalf of the Petitioner seeking quashing of FIR No.0043/2019 under Sections 279/334 IPC registered at PS: Wazirabad, in terms of Settlement Deed dated 01.07.2024.

2. Issue notice.

3. Learned APP for the State and Resopndent No.2 appear on advance notice and accept notice.

4. Resopndent No.2 injured, present in Court, submits that she had suffered fracture in her left arm aside from other injuries. IO present in the Court has identified the injured and stated that chargesheet has been filed under Sections 279/338 IPC. On enquiry, Respondent No.2 has stated that she has already received Rs.12,00,000/- under Motor Vehicle Act from MACT.

5. The parties have submitted that all the disputes have been amicably settled vide Settlement Deed dated 01.07.2024 and thus, no fruitful purpose

will be served in continuing with the FIR.

6. The present Petition has been signed by the Petitioners and is supported by their Affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Settlement Deed dated 01.07.2024 and they also submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is related to friends cum neighbours, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

8. Moreover, there is no legal impediment in quashing the FIR in question.

9. Accordingly, FIR No.0043/2019 under Sections 279/334 IPC registered at PS: Wazirabad and all other proceedings emanating therefrom are quashed.

10. Petition alongwith pending Application, is disposed of accordingly.
