Counsels for the parties inform the Court that settlement agreement dated 14^th December, 2023 has been executed before the Delhi High Court Mediation and Conciliation Centre which has been placed on record. The terms of the settlement are contained in para 1-6 of the said settlement agreement. The said settlement has been signed by the authorised signatory of the parties as well as by the respective counsels. This Court has gone at

the terms of the settlement and finds them to be lawful.

Accordingly, nothing survives for adjudication in these suits. Decreesheet be drawn up in terms of para 42 (a) and (b) of the plaint in CS(COMM) 494/2023 in favour of the plaintiff. In CS(COMM) 479/2023, decree-sheet be drawn up in terms of para 43 (a) and (b) in favour of the plaintiffs.

The parties shall be bound by the terms of the settlement.

Considering the matter has been settled through mediation, the court fees be refunded to plaintiffs in both the suits in terms of Section 16 of the Court Fees Act.

Counsel for plaintiffs in CS(COMM) 479/2023 states that the plaintiffs have undergone a merger with its sister concern and he seeks place on record an amended memo of parties to bring on record the merged entity as the plaintiffs.

Liberty is granted.

The same may be placed on record within the next week.

Accordingly, the refund certificate in respect of the court fees be issued in the name of the merged entity, pursuant to the amended memo of parties being filed.

Accordingly, suits are disposed of. Pending applications are also disposed of.
