The present proceedings are instituted under Article 226 of the Constitution of India and Section 528 of BNSS 2023, on behalf of the petitioner seeking quashing of FIR No. 391/2024 registered under Section 110 of BNS, 2023 at P.S. Mandawli Fazal Pur, Delhi, on the ground that the parties have amicably settled their disputes.

The present FIR is an outcome of a dispute between complainant/respondent No.2 (sister) and petitioner (brother), wherein the petitioner hit the respondent No.2 on the head with a brick.

Learned ASC for the State, on instructions, submits that the petitioner is the only accused person and respondent No.2 is the complainant/victim in

the present case. He further submits that the parties are siblings, i.e., brother and sister.

Learned counsel for the petitioner submits that the petitioner is a student and pursing Software Engineering from Amity University, Noida. It is further submitted that the present FIR was registered due to some misunderstanding between the brother and sister and, with the intervention of family members, they have amicably settled their disputes, vide Compromise Deed/MOU dated 20.08.2024, a copy of which has been placed on record. In terms of the settlement, the respondent No.2/complainant has no remaining grievances against the petitioner.

The petitioner, who is present in Court, has been identified by his counsel as well as by the I.O./SI Aman Singh, P.S. Mandawali, Delhi. The petitioner has shown remorse for his conduct and undertakes to not repeat the same in future.

Respondent No. 2 is also present in Court and has been identified by the IO. She states that she has forgiven the acts of her brother i.e. the petitioner and has settled the dispute out of her own free will, volition and without any coercion. She further states that she has no objection if the present FIR and consequent proceedings are quashed.

Learned counsel for the petitioner submits that no other proceedings are pending between the parties.

The parties shall remain bound by the statements and undertaking made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed.
