The present application is filed seeking grant of pre-arrest bail in FIR No. 482/2023 dated 16.09.2023 registered at Police Station Ambedkar Nagar for offences under Sections 420/467/468/384/447/120B of the Indian Penal Code, 1860 (‘ IPC ’).

The FIR was registered on a complaint given by the complainant, Ashok Kumar. It is alleged that the accused Hargyan sold the subject property to the complainant vide registered sale deed dated 23.06.2006. It is alleged that thereafter the applicant in connivance with other co-accused persons forged and fabricated several documents in the form of rent deeds to resell the subject property.

This Court vide order dated 09.02.2024 referred the parties to the Delhi High Court Mediation and Conciliation Centre.

The learned counsel for the parties submit that there are certain modalities which are left to be finalized before the Delhi High Court Mediation and Conciliation Centre.

They, on instructions, undertake that the terms and the conditions of the settlement would be duly complied with. 7. This Court by order dated 18.01.2024 had protected the applicant against any coercive steps. It is not alleged that the applicant has misused the liberty in any manner whatsoever.

In view of the above, the present application is allowed and the applicant in the event of arrest, is directed to be admitted on bail on furnishing a bail bond for a sum of ₹25,000/- with one surety of the like amount subject to the satisfaction of the concerned SHO, on the following conditions:

a. The applicant shall join and cooperate with the investigation as and when directed by the IO;

b. The applicant shall not leave the boundaries of the country without informing the IO/ SHO concerned;

¶20

c. The applicant shall not contact the witnesses or tamper with the evidence in any manner;

¶21

d. The applicant shall give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times;

e. The applicant shall provide the address of his residence to the concerned IO/SHO and shall not change the same without informing the IO/SHO.

In the event of there being any FIR/DD entry / complaint lodged against the applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 10. It is clarified that any observations made in the present
