Learned counsel for the petitioner submits that the genesis of the present petition is the award dated 01.03.2018 whereby the petitioner was not granted pre-suit interest.

Learned counsel submits that aggrieved of this, the award was challenged before the District Court by OMP(T) (COMM) 35/2017. Learned counsel submits that OMP(T) (COMM) 35/2017 tilted as PARAMJEET SINGH NARULA vs. DELHI DEVELOPMENT AUTHORITY was dismissed by learned District Judge, Commercial Court vide order dated 03.05.2023. Learned counsel further submits that against this order, the petitioner has filed FAO 77/2024 titled as PARAMJEET SINGH NARULA vs. DELHI DEVELOPMENT AUTHORITY .

Learned counsel submits that the present petition was filed for the appointment of an arbitrator for adjudication of the claim of the petitioner regarding the pre-suit claim. Learned counsel submits that since the FAO 77/2024 titled as PARAMJEET SINGH NARULA vs. DELHI DEVELOPMENT AUTHORITY has already been filed and the same has also been transferred to this Court, the petitioner may be allowed to withdraw the present petition with liberty to agitate/press her claim in FAO 77/2024 titled as PARAMJEET SINGH NARULA vs. DELHI DEVELOPMENT AUTHORITY .

In view of the submissions made above, the present petition along with pending application stands dismissed as withdrawn with the liberty as prayed for.
