Present writ petition had been instituted by this Court on its own motion relying on a newspaper report dated 28^th April, 2023, wherein it was stated that an agency which was supplying meals to the shelter house situated in Nizamuddin had stopped supplying meals.

On 28^th April, 2023, this Court had directed Akshaya Patra Foundation, which was earlier providing food to all the night shelters to continue to provide food to the night shelters. The Respondents were directed to make payments.

Today, learned counsel for DUSIB states that tenders have been floated for supply of food in DUSIB shelters. He states that while the technical bids have been evaluated, financial bids are yet to be opened. He states that the process has been slightly delayed due to coming into force of the Model Code of Conduct.

He further assures and undertakes to this Court that the outstanding payments of Akshaya Patra Foundation for the months of January and March, 2024 shall be cleared within a week. 5. Learned counsel for GNCTD states that the dues of Akshaya Patra Foundation for the month of February, 2024 have been cleared today. 6. Since a tender has already been issued for supply of food to DUSIB Shelter homes, this Court disposes of the present writ petition by directing DUSIB to award the contract, as expeditiously as possible. GNCTD and DUSIB are directed to clear the outstanding payment to Akshaya Patra Foundation within four weeks in accordance with law. Needless to state that till the new tender is awarded, the arrangement made by this Court shall continue.
