The present writ petition seeks a writ of certiorari for calling forth the records of Respondent pertaining to a notice dated 14^th March, 2024¹ , calling upon the Petitioner to appear before the ‘Committee of Petitions’ of the Respondent, for deliberation on the representation regarding ‘ demolition of JJ Basti Cluster near Sunder Nursery ’, and to quash the same.

On 18^th March, 2023, Mr. Sameer Vashisht, ASC representing the Respondent/Legislative Assembly of the National Capital Territory of Delhi, informed the court that the Petitioner would not be required to appear in person but would instead receive a questionnaire. Accordingly, the

proceedings were adjourned based on this representation.

Today, Mr. Vashisht acknowledged that, as of this date, no questionnaire has been sent to the Petitioner. He proposes that, given these circumstances, the petition may be disposed of in accordance with the statements made on 18^th March, 2023. He further states that should the Respondent find it necessary, they will issue a questionnaire to the Petitioner. If the responses provided are unsatisfactory or if further clarification is required, and there exists a valid reason, the Respondent will then issue an appropriate notice to appear to the Petitioner.

The statement made by Mr. Vashisht on 18^th March, 2024 and the statement noted above are taken on record.

Accordingly, the present petition is disposed of with liberty to the Petitioner to approach this Court, in the event a cause of action arises. It is further clarified that the Petitioner shall have the liberty to challenge any questionnaire issued by the Respondent, should such a challenge be permissible, in accordance with applicable law.

All rights and contentions of the parties are left open.
