The Petitioner, an NGO, has invoked the jurisdiction of this Court seeking directions to Respondent No. 1, Delhi Metro Rail Corporation (DMRC) to take immediate action for removing/ taking possession of unauthorized occupants “Anytime Tour & Travels” from using the premises of the toilet blocks near Gate No. 8 of Kashmere Gate Metro Station, Delhi, and other locations. Further, they also seek directions for DMRC to take actions for cancellation of the Agreement dated 7^th October, 2019 entered into with Respondent No. 3.

At the outset, Mr. Puskhar Sood, counsel for Respondent No. 1, states

on instructions that the contract with Respondent No. 3 already stands terminated. He places reliance on letter dated 15^th July, 2024, copy whereof has been handed over across the board and is taken on record. The operative portion of the said communication reads as follows:

In view of above, a show cause notice of termination has already been served to you vide referred notice dated- 06.06.2024. The curative period of 30 days to amend the detect has already been lapsed. Hence, the contract agreement dated 17.10.2019 signed between DMRC and M/s Snapex Overseas (Garv Toiet) stand terminated with immediate effect. Further, you are directed to vacate the premises with all man and material within 10 days from issuance of the Termination Notice. Non compliance of the above instruction, DMRC may take legal action against you.
