This petition has been filed praying for the following relief:-

“(a) Issue a writ, direction or order in the nature of mandamus or any other writ, order or direction, directing the Respondents to ascertain the quantity of raw petroleum coke (RPC) imported including imports due to be made by the licensed calciners, against the total import quota allocated to the licensed calciners for the present financial year of 2019-20, and re-allocate the unutilized import quota by 31 January 2020 to Petitioner No. 1 and such other licensed calciners as determined by this Hon'ble Court;

(b) Pass ad-interim / interim / ex-parte order(s) in respect of the prayers hereinabove;”

The learned counsel for the respondents, on instructions, submits that the respondents have taken a decision to reallocate the unutilized import quota of Raw Petroleum Coke (RPC). She submits that this process shall take three weeks.

The learned senior counsel for the petitioners, however, submits that incase the respondents are granted three weeks to do this exercise, the exercise maybe rendered infructuous as it may not give enough time to the petitioners and the other concerned parties to import the RPC within the financial year.

Having considered the submissions made, it is directed that the respondent shall complete the exercise of reallocation within a period of two weeks from today and communicate its decision to the concerned parties accordingly.

The petition is disposed of with the above directions.
