On the previous dated i.e. 10.01.2020, the following order was passed: “1. Mr. Mayank Manish, Advocate, who appears for the petitioner, states that the petitioner wishes to confine the writ petition to the relief claimed in prayer clause (b), which reads as follows :-

“Issue an appropriate writ/direction or orders directing the NRC to respond to the query of the affiliating University regarding requirement of NOC for the petitioner institution”

2. It is Mr. Mayank Manish’s contention that the affiliating University, i.e., Dr. Ram Manohar Lohia Avadh University, Faizabad, had via letter dated 01.05.2019 addressed to the Regional Director, NRC queried as to whether NOC was required to be issued to the petitioner.

3. Issue notice. Ms. Dwivedi, Standing Counsel accepts notice on behalf of the respondents. Ms. Dwivedi says she will revert with instructions.

4. A copy of the letter dated 01.05.2019 and the reply, if any, sent by NRC to the aforementioned affiliating university will be placed on record before the next date of hearing.

5. Renotify on 4^th February, 2020.”

Mr. Mayank Manish, who appears on behalf of the petitioner, says that the date shown on the letter, referred to in paragraph 4, which was addressed by the affiliating university (i.e. Dr. Ram Manohar Lohia Avadh University, Faizabad to the Regional Director) to NRC is 30.04.2019 and not 01.05.2019. A copy of the letter has been placed before me.

2.1 For the purposes of good order and record, the Registry will scan and upload the copy of the aforesaid letter.

To be noted, I am informed by Mr. Mohit Siwach, who appears for the respondents, that he has ascertained from the NCTE as to whether any response was given to the aforementioned letter.

3.1 Mr. Siwach says that he has been instructed to convey that the NCTE has not sent out any response to the letter dated 30.04.2019.

In view of the aforesaid, the NRC is directed to consider and thereafter respond to the letter dated 30.04.2019 addressed to it by the affiliating university i.e. Dr. Ram Manohar Lohia Avadh University, Faizabad.

The response will be sent by the NRC at the earliest, though, not later than one week from the receipt of a copy of the order passed today.

As prayed by Mr. Manish, the captioned writ petition is disposed of in the aforesaid terms.
