The present petition has been filed by the petitioner with the following prayers:

“In view of the stated facts and circumstances, it is most respectfully prayed that this Hon’ble Court may be pleased to: -

¶11

(a) Initiate the contempt proceedings against the respondents for grossly violating the court order dated 21.07.2008 passed by this Hon’ble Court in W.P.(C) 5795 of 2007 and causing obstruction to justice by abusing process of this Hon’ble Court; and

¶12

(b) Pass an urgent direction to the Respondents to undertake immediate and forthwith removal of the collection of garbage caused due to shedding of leaves from the trees, from the service lane adjoining the residential premises of the petitioner and further undertake complete cleaning of the said service lane on a regular basis; and

(c) Direct the respondents to immediately remove the iron gates blocking both entrances to the above referred service lane; and

¶14

(d) Direct the officials to undertake immediately and thereafter, regular pruning of the eucalyptus (Safeda) Trees.

(e) Pass any other order (s) as this Hon’ble Court may deem fit in the interest of justice.”

Counsel for the respondent has placed before me three photographs to contend that the pruning of the trees has been done and no part of the branch of the tree is falling on the property of the petitioner, even though learned counsel for the petitioner states, still certain pruning needs to be done.

I deem it appropriate to close the contempt petition by observing if the petitioner has any grievance in future he shall communicate with the Assistant Director, Horticulture Department of the SDMC who shall attend the request of the petitioner within a reasonable time.
