1. The petitioner has filed this petition seeking following reliefs:

“ 10.1. That, the Hon’ble Court be pleased to direct the respondent No.4 to decide the pending application of

the petitioner for grant of regular pay from the initial date of appointment scale with effect, and grant the same as the case of the petitioner is squarely covered by the judgment passed in O.A. No. 2745/ Madhukant Yadu & 56 others vs. State of M.P. & Ors. (Annexure P/1).

10.2. That, any other relief which this Hon’ble Court deems fit in the present facts and circumstances of the case may kindly be granted.”

1. Learned counsel for the State submitted that according to circular dated 13.2.2008, the petitioner was appointed on the post of Assistant Teacher on 28.6.1975, therefore, he would not be entitled to get the regular pay-scale according to circular dated 13.2.2008. She would refer to Annexure-R/1 dated 13.2.2008, wherein it is held that the teachers appointed between 1.1.1982 to 13.12.1995 would be entitled to get benefit of regular pay-scale. She would submit that the petitioner was appointed on the post of Assistant Teacher on 28.6.1975 prior to 1.1.1982, therefore, he would not be entitled for regular payscale.

1. Taking into consideration the circular dated 13.2.2008, in opinion of this Court, no case is made out for interference.

1. Consequently, this petition fails and is hereby dismissed .
