The petitioner was on the waiting list and when no steps were taken to fill up the vacant post from the waiting list, WPS No. 2301 of 2012 was filed on 25.06.2012, and the same was disposed of vide Order dated 04.09.2012 granting liberty to respondent No. 4 to prefer an appeal before the competent authority in terms of Rule 13 of the Rules 2007. Respondent No. 4 preferred an appeal before the Collector on 03.10.2012 and the same was dismissed vide Order dated 06.05.2013 on the ground that the name of respondent No. 4 appears in the waiting list at Serial No. 4 and the candidates who are at Serial No. 1 to 3 in the wait list have not been appointed having more marks than respondent No. 4. Thereafter, respondent No. 4 preferred a revision before the Commissioner, Surguja Division and vide Order dated 19.05.2014, the same was allowed on the ground that out of 76 candidates, who were selected, only 65 candidates joined their services and 11 posts remained vacant, but no steps were taken by the Janpad Panchayat to fill up those posts from the wait list. It was also observed by the Commissioner, Surguja Division in its order that on account of a Circular dated 07.02.2011 issued by the State Government, the validity of the wait list was diluted.
