innocent, he has been falsely implicated in the instant crime, he has not committed any offence as alleged. There are no external injuries over the person of the deceased, nature of death is also mentioned as accident and not homicidal. The material witnesses have now been examined and they have not supported the case of prosecution and from their evidence, no offence as alleged against the applicant would be made out. One other co-accused who is a juvenile is enlarged on bail.
