M/S. Watergrace Products through Proprietor, Shri. Chetan Bora Vs the State of Maharashtra through Secretary and Ors.

Applicant for stay to the execution and/or operation and/or implementation and/or to the effect of the impugned order dated 31^st December, 2015 was rejected by this Court and the ad-interim relief claimed by the Petitioner in the WP No. 380 of 2016 was also rejected by this Court.

Shri Jahagirdar, learned Senior Counsel appearing on behalf of the Petitioner submits that the Petitioner is now ready to give an undertaking to this Court.

In our view, it will not be possible to accept the undertaking since the tender process is at an advanced stage. Hence, civil application is disposed of. Place the writ petition for final disposal after two weeks. The further progress of the tender shall be subject to final outcome of the writ petition.
