Sidhava Sangappa Munale Vs the Divisional Caste Certificate Scrutiny NO.1, Solapur, through Member Secretary and Ors.

Learned Counsel appearing for the petitioner states that as per instructions received by him, the caste claim of the petitioner is not yet disposed of. Learned AGP states that on the last date he received instructions that though the order was ready, it was not signed.

Considering the limited prayer made in this petition, we dispose of the petition by passing the following order:

(i) We direct the petitioner to appear before the first Respondent Caste Scrutiny Committee on 25^th July,2014 at 11:00 a.m. If the caste claim of the petitioner is already disposed of, a copy of the order passed be

supplied to the petitioner on 25^th July,2014. If the order is not ready, on 25^th July, 2014 the Caste Scrutiny Committee shall fix a date for pronouncement of order to enable the petitioner to remain present before the Caste Scrutiny Committee;

(ii) If the caste claim is decided against the petitioner, for a period of four weeks from the date on which the order is served to the petitioner, no adverse action shall be taken against the petitioner on the basis of such order;

(iii) We make it clear that we have not made any adjudication

on the merits of the caste claim and all contentions of the parties are kept open;

¶23

(iv) Parties to act upon an authenticated copy of this order.
