Management was well aware of the fact that he holds B.A. qualification, as such was appointed as untrained teacher. Said fact is justified in view of the approval orders issued by the Education Officer from time to time in approving the services of respondent No.2 on the post of Assistant Teacher till date of his termination. The communication dated 14th September 2001 which was issued by the Education Officer placed on record reflects that after the appeal was allowed by the Tribunal, the Education Officer has considered the date of appointment of respondent No.2 as 1st July 1996 and granted approval to his appointment under Nomadic Tribe category by considering his qualification as B.A. on the post of Assistant Teacher. While dealing with the said approval letter, the Education Officer has also referred to the appointments carried out by the petitioner – Management in the year 2001-2002. Be that as it may, the fact that the services of the respondent No.2 were approved by the Education Officer from time to time, is not in dispute. In that view of the matter, the issue that the respondent No.2 was not holding B.A., B.Ed. qualification, but was holding B.A. qualification, is hardly of any assistance to the petitioner – Management. The finding given by the Tribunal on that count does not call for any interference.
