We, however, prima facie find on perusing the documents annexed to the applications for intervention and on hearing the learned Counsel for the Municipal Council that the intervenors have purchased the plots on the land in question by registered sale deeds. We further prima facie find that the permission has been granted by the Municipal Council to some of the intervenors to make construction on the plots purchased by them. In the facts of the case, it would not be possible for this Court to direct the Municipal Council to remove the alleged encroachment as sought by the petitioner herein. If the petitioner is really aggrieved by the action on the part of the intervenors, the petitioner is free to file civil suit against the persons who have allegedly made the construction on the land in question. In the Civil Court, the petitioner as also the other parties would be granted an opportunity to tender evidence, both oral and documentary to prove their respective cases. In the Public Interest Litigation, the prayers made by the petitioner cannot be granted, especially when we have come across various documents tendered by the intervenors to prima facie show that the intervenors are the owners of the plots on the land in question and some of the intervenors are also permitted by the Municipal Council to make construction on the plots in the land in question.
