1Though the petition was kept back on two occasions, none appeared for the petitioner. The petitioner has made allegations regarding grave illegalities committed in the recruitment process of Directorate of Vocational Education and Training, Pune Region, Pune in various categories. Apart from the other objections of the learned counsel for respondent Nos.3 to 5, he raises issue of maintainability of the Public Interest Litigation in service matters.

2We find that there is an affidavit of Shri Dilip Balkrishna Mujumdar, Under Secretary to the Government, Higher and Technical Education Department, Mantralaya, Mumbai in which various actions taken have been set out. It records that the State Government had constituted a Committee

under the Chairmanship of Shri Devadkar which recommended Departmental Enquiry proceedings should be initiated against the respondent Nos.3 and 4. It is stated that an Enquiry Officer has been appointed on 18th February 2011 for enquiring into the charges levelled against the respondent No.3 and the enquiry is in progress. It is stated that as against the respondent No.4 also an Enquiry Officer has been appointed and the Departmental Enquiry is in progress. In paragraph 5, charges framed against the respondent Nos.3 and 4 have been quoted.

3It is obvious that now the Departmental Enquiries will be taken to its logical end. Considering what is stated in the affidavit of Shri Dilip Balkrishna Mujumdar, Under Secretary, at this stage, it is not necessary to entertain this Public Interest Litigation. Accordingly, we dispose of the same. Issue of maintainability is kept open.
