After arguing the matter for some time, the learned Counsel for the Petitioner states that since the Petitioner has already filed a complaint under Section 138 of the Negotiable Instrument Act and the Petitioner is contemplating to pursue civil remedy in respect of the two dishonoured cheques dated 25th September, 2011 and 10th January, 2012, the Petitioner is not desirous of perusing action for winding up in respect of the amounts of the dishonoured cheques. He, accordingly, seeks leave to withdraw the Company Petition.
