The applicant is accused of the offence punishable under Section 420 read with 34 and 395 of the Indian Penal Code. The complainant is resident of village, Sabegaon Diwa of District : Thane. The alleged incident had occurred on 1st October, 2011. It is alleged that accused No.1 Nilesh was known to the complainant prior to the date of incident. Accused Nilesh had intimated the complainant that a pot containing gold coins was discovered in the field of Nilesh and that the complainant was interested in buying the gold coins he should come to the place of Nilesh. It is alleged that induced by his representation of the accused the complainant left his native place in Innova car along with one of his companions with cash amount of Rs.9,00,000/-. There was a meting at Mangrulpir between accused Nilesh and one more accused with the complainant and his companion. The complainant was taken to a deserted place where 5-6 other persons suddenly emerged from Innova car and had taken away cash amount of the complainant. The complainant was frightened due to sudden incident and he went back to his native place. He was so much disturbed that he did not approach police for 3-4 days. It appears from the first information report that he approached local police station on 4th October, 2011 and he was directed to lodge report at Asegaon Police Station in Washim district. Accordingly, he came here and lodged report on 10th October, 2011.
