Heard Mr.N.B.Bargat, learned counsel for the applicants and Ms Sangeeta Jachak, learned Additional Public Prosecutor for respondent/State.

The applicants are apprehending arrest in Crime No. 156 of 2012 of Pandharkawada Police Station for the offences punishable under Sections 498-A and 304B read with Section 34 of the Indian Penal Code. Main accused in this case is husband of the deceased. Dead body of the deceased was found on the bank of river. It is submitted by learned Additional Public Prosecutor that the cause of death was drowning.

The learned counsel for the applicants submit that the applicnats have nothing to do with the alleged offence as the applicnats are staying 70 kms. Away from the village where the deceased and her husband have been staying. The husband of the deceased had been arrested and he has released on bail. The applicants are made accused only on a bare statement made by father of the deceased that the applicants always used to instigate husband of the deceased to demand dowry. There is no other material on record. Since the applicants are staying 70 kms. Away from the village of the deceased and her husband, this

application appears to have been motivated. Moreover, custody of the applicants is not going to yield anything. Investigation can be done without custody. Hence, I pass the following order.

The applicants be released on bail in the sum of rupees fifteen thousand with one solvent surety each in the like amount or two sureties of rupees seven thousand five hundred each, in the event of their arrest in Crime No. 156 of 2012 of Pandharkawada Police Station for the offences punishable under Sections 498-A and 304B read with Section 34 of the Indian Penal Code.

The applicants shall attend Pandharkawada Police Station on every Sunday in between 3.00 to 5.00 p.m. for four Sundays starting from 21^st October, 2012. This condition will stand deleted if the chargesheet is filed before four weeks from today.
