The learned counsel appearing for the parties commonly concede that these writ petitions can be disposed of in terms of the order of the Division Bench dated 8th December, 2008 passed in Writ Petition (lodg.) 2756 of 2008 in Benzy Travels of India Pvt. Ltd. v. The State of Maharashtra. The petitioner company in both the matters shall also give an undertaking that the vehicle shall not be brought again within Greater Bombay and shall not be plied in the city of Greater Bombay. The Writ Petitions are accordingly disposed of in those terms subject to filing of the undertaking.
There shall be no order as to costs.
