1.Mr.Gaikwad, the learned Counsel for the Applicant, has
placed before us a photo-stat copy of the Death
Certificate issued on 27.7.2009 by the Thane Municipal
Corporation. As per the said certificate, Vasant, son
of Vishnu Modgi, died on 13.3.2007 and the said Vasant
was impleaded as Respondent No.5 in Writ Petition No.
194 of 2005
2.Mr.Gaikwad, therefore, seeks leave to withdraw this
Application with liberty to file a fresh Application to
bring Legal Representatives of Respondent No.5 on
record.
3.Leave granted.
4.Application is disposed as withdrawn.
