1.Heard the learned Counsel appearing on behalf of
the Applicant, Original Complainant and the learned
APP for the State.

2.Pursuant to the interim order passed by this
Court dated 30th September, 2009, interim protection
was granted to the Applicants.

3.The Applicants also have pursuant to the
direction given by this Court, attended the said
police station. Since the Applicants have already
been examined by the Police, further custodial

interrogation of the Applicants is not necessary.

4.The dispute is essentially in between the two
brothers in respect of the suit land. The said
dispute is pending before the Civil Court. Taking
into consideration the fact that the subject matter is
essentially of a civil nature and since the Applicants
have already been examined by the police, the
Applicants need not be detained any further.

5.The Applicants, therefore, in the event of their
arrest in connection with C.R. No.105 of 2009
registered with Jat Police Station for the offence
punishable under sections 326, 324, 323, 341, 447 r/w.
34 of the Indian Penal Code, they shall be released on
bail in a sum of Rs.10,000/- each with one or two
sureties in the like amount. They shall report to the
concerned police station, as and when called.
