1.Heard the learned Counsel appearing on behalf
of the Applicant and the learned APP for the
State.

2.The first application filed by the Applicant
was allowed to be withdrawn by order dated 20th
March, 2009. An offence has been registered
against the present Applicant vide C.R. No.
I-152/2008 registered with Bhiwandi Town Police
Station for the offence punishable under section
366 of the Indian Penal Code and under sections

3,4,5,6 and 7(1B) of The Immoral Traffic
(Prevention) Act. Liberty was granted to the

Applicant to apply for bail in the event the
trial is not over within a period of six months.

3.I am informed that charg is not yet framed
and the trial is not likely to be over in near
future. The Applicant is an old lady and the
allegations against her is that she is running
brothel business. Though there is no change in
the circumstance, in my view, taking into
consideration the fact that the Applicant is in
jail since 5th July, 2008 and the trial is not
likely to be over immediately in near future, the
Applicant deserves to be released on bail.

4.The Applicant be released on bail in a sum of
Rs.5,000/- with one or two sureties in the like
amount. The Applicant shall report to the
concerned police station once in a month.
