1.The learned Counsel for the Applicant submits
that the Complainant and the Applicant have settled
the dispute by order dated 14th August, 2009. The
Applicant was directed to implead the Complainant as a
party respondent.

2.On 29th September, 2009, both the Complainant and
the Applicant had made a statement in this Court that
the settlement talk is going on. The statement made
by the Learned Counsel for the Applicant that the
parties have settled the dispute is accepted. All
other co-accused have already been released on bail.
3.The complaint under section 498(A), 406 , 34 of
the Indian Penal Code has been filed by the

Complainant against the present Applicant and others.
In view of the statement,the Applicant is entitled to
get the anticipatory bail. In the event of the arrest
by Vakola Police Station in connection with C.R. No.
53/2009 for the offence punishable under sections
498A, 406, 34 of the Indian Penal Code, the Applicant
be released on bail in a sum of Rs.5,000/- with one or
two sureties in the like amount. The Applicant shall
report to the concerned police station as and when
called.
