1. This court is not satisfied with the reasons
given in the Affidavit-in-support of the Notice of

Motion for restoring the petition. In view of the
nature of litigation, we are inclined to restore the
petition on the condition that the Petitioner will
pay cost of Rs.5,000/-. Learned Counsel for the
Petitioner, submits that, the cost may be credited to
the Account of High Court Legal Aid Committee. Cost
to be deposited within a period of one week which
shall be a condition precedent. On failure of the
Petitioner to deposit the cost, the order restoring
the petition would stand recalled without any further
reference to the court.
