 1. This is a revision impugning the two judgments
 of the lower Courts convicting the applicant under

 Section 138 of the Negotiable Instruments Act.
 After the judgment of the revisional Court, the
 applicant has been taken into custody. The matter
 is now mutually settled between the parties and the
 Complainant filed an affidavit dated 10.2.2006
 requesting the leave of the Court to compound the
 offence as entire amount has been received by him.

 The Complainant is present in the Court and is
 identified by his Advocate.

 2. Heard the Advocate for the applicant and the

 Advocate for the Complainant. In view of the

 affidavit which is filed and the prayer made
 there-in, the offence of Section 138 of Negotiable
 Instruments Act is allowed to be compounded. The
 impugned judgment and orders therefore, stands set
 aside and the accused is acquitted. Since the
 accused is in custody, in view of the compounding,
 he may be released forthwith. Revision Application
 stands disposed of accordingly.

 . Parties to act on an ordinary copy of this order
 duly authenticated by the Private Secretary of this
 Court as a true copy.
