Above mentioned application has been filed by the learned counsel for the appellant under Article 215 in the Constitution of India which have dealt with section 12 in the contempt of court.

On 15^th November, 20017, the status quo order with regard to FDR of the appellant which is lying in the Indian Mercantile Co-operative Bank was passed in the presence of both the parties.

Despite of the status quo order, the bank has deposited the amount into the account of the respondent who has kept the said amount in the F.D. of Allahabad Bank,

Main branch, Lucknow. When the matter listed on the last date, the same was adjourned to today’s date for seeking the instructions by Sh. Nitesh Rana who has made now suggestion to the learned counsel for the appellant that let the FD may be broken and the entire money should be deposited in the FD account in the name of this Tribunal.

The learned counsel for the appellant has no objection for the same. The order is passed accordingly with consent of both the parties. Hence MP is disposed of.
